The new house at 915 9th Street has a 5 foot closed-side setback on the west property line. The final setback verification indicates the building foundation is 4.86 feet from the property line. The encroachment was approved in error by staff when the structural foundation plans were approved with the building permit but was not identified until the house was constructed. The Director approves a minor setback adjustment finding the setback is not reduced more than 20% and the practical difficulty was the reasonable reliance on the approved construction documents.
